Does Florida Have a Three-Step Rule?

One of the biggest myths that exist about Florida Concealed Carry Law is the three step rule.


What Is The Three Step Rule?

The three-step rule says that in order to transport a firearm inside of a vehicle, there has to be three distinct actions that a person must take to gain access to the firearm. An example of this would be a person who has a firearm unloaded, inside of a zippered bag and locked in the glove box.
 

Step One -  The firearm is unloaded.

Step Two - The firearm is placed inside of a zippered gun bag.

Step Three - The gun case is locked inside of the glove box.

If a person needed to gain access to the firearm for self-defense, they would first have to unlock and open the glove box, that's step one. Next, they would have to remove the firearm from the gun case, that's step two. Finally, they would need to load the firearm, that's step three.

Needless to say, this is extremely time consuming and our victim would probably be dead by this point.

What Is The Real Law In Florida?

Florida Statutes 790.25 (5)  POSSESSION IN PRIVATE CONVEYANCE. ….it is lawful and is not a violation…. for a person 18 years of age or older to possess a concealed firearm or other weapon for self-defense or other lawful purpose within the interior of a private conveyance, without a license, if the firearm or other weapon is securely encased or is otherwise not readily accessible for immediate use…

Why Do Law Enforcement Officers Talk About the Three Step Rule?

Despite the fact that the three step rule has NEVER EXISTED according to Florida concealed carry lawS, it is still frequently stated as fact by uneducated gun owners and law enforcement officers.


I am a big supporter of police officers. I never want to live in a world without the rule of law. However police officers are expected to know a-lot of different laws which means things are going to slip through the cracks. And this is why it is so important for you guys to really get a deep understanding of Florida concealed carry laws.
