My wife and children know that I love firearms; because of this, I frequently receive guns as gifts. In fact, many years ago Tiffany purchased a 1911 pistol from a local gun store and had a message engraved from my children for Father’s Day.

You're probably wondering how she was legally allowed to purchase a firearm from a licensed gun dealer for another person.
How Is This Legal?
If you remember in a previous article “How to Purchase a Firearm from a Licensed Dealer,” we discussed the ATF form 4473 and more specifically question 21.a. asks:
ATF Form 4473 21.a. Are you the actual transferee/buyer of the firearm(s) listed on this form?In the example given above, Tiffany would answer yes to question 21.a., because she is purchasing the firearm legally for herself. The reason this is legal is because I didn’t ask her to purchase the firearm, I didn’t give her any money to buy the firearm, and I am legally allowed to purchase the firearm myself.
This Is Scary...
A straw purchase would be the exact opposite. Recently one of my students was walking into a local gun store when she was stopped by a man in the parking lot. This man told her that he would give her $1,000 to purchase an AR-15 and $500 for her time. This is would be a straw purchase because the man is asking the women to purchase a firearm that he is obviously not able to purchase on his own, and he was providing the money.
When Tiffany is ready to give me the firearm as a gift, she would be conducting a private firearm transaction, and she would be required to follow the rules associated with private transactions.
